Attorneys Mark Malloy and Sam Morris were victorious in an appeal filed in the Superior Court of New Jersey. The case involved an insurance coverage dispute between two insurers that arose out of the defense of an underlying medical malpractice action. After settlement of the underlying action, the other insurer contended that our client’s policy covered the acts of all defendants, including both the defendant doctor and the defendant healthcare facility. Attorneys Malloy and Morris successfully argued that the client’s policy only covered the actions of the doctor, and that the other insurer’s policy provided entity coverage.
