We are proud to share that Meissner Tierney appellate attorneys Caleb R. Gerbitz and Matthew P. Martin secured a complete appellate victory on behalf of our clients, Tribella Properties LLC and its members. On August 11, 2026, District III of the Wisconsin Court of Appeals issued its decision in the consolidated appeal, affirming the circuit court’s judgment in full and giving our clients a complete win across every issue on appeal.
The appeal involved a unique blend of issues, ranging from intensive factual disputes over project revenues, to challenging legal questions involving the reformation of deeds provided as collateral into mortgages. The result reflects the kind of disciplined, record-focused appellate advocacy our clients rely on when the stakes are highest.
The win marks Caleb Gerbitz’s sixth appellate victory of 2026 and his tenth consecutive appellate victory since 2024. For Matthew Martin, it is his second appellate victory since joining the firm last year.
