Meissner Tierney attorneys Mark D. Malloy and Matthew V. Fisher recently received a favorable decision from the Wisconsin Court of Appeals. The client, a leading multiline national insurer, was dismissed by way of declaratory judgment from an underlying tort action involving two fatal shootings outside a Jefferson County tavern. The Court of Appeals, District IV, affirmed the arguments advanced by Malloy and Fisher that declaratory judgment was procedurally proper, and that the underlying conduct of the insured did not constitute an “occurrence” triggering an initial grant of coverage.
