Attorney Joseph Sarmiento Authors Article “Phishing for Coverage: Insurance Coverage for Phishing Schemes Under Computer Fraud Provisions” for the Defense Research Institute
Attorney Joseph Sarmiento, a member of Meissner Tierney’s litigation practice group, recently authored an article for the Defense Research Institute’s Insurance Law Committee Newsletter entitled, "Phishing for Coverage: Insurance Coverage for Phishing Schemes under Computer Fraud Provisions."
In the article, Joe examines how courts are addressing the rising number of cyber security attacks as it pertains to insurance coverage and the growing sentiment that there is a split of authority on whether phishing schemes are covered by computer fraud coverage parts. However, instead of a growing split, Joe outlines some recent national cases which show a coalescence of authority that makes coverage determinations based upon the facts of each case and the clear language contained in the policies. He offers an overview of five recent phishing cases and assesses how the phishing schemes were carried out and the outcome or determination on whether these cases were covered under computer fraud.
